TERMS & CONDITIONS OF SERVICE

1. BOOKINGS & CONFIRMATION

A booking is confirmed only once the quotation is accepted in writing and the required deposit (if applicable) isreceived. Bookings should be made at least 1–2 weeks in advance of the scheduled shoot date.

 

2. PAYMENT TERMS

2.1 Deposits: A 50% non-refundable deposit is required to secure all once-off projects. Monthly retainer clients arebilled according to agreed monthly terms.

2.2 Balance Payment: The remaining balance is payable upon delivery of final edited content. Final deliverablesmay be withheld until full payment is received.

2.3 Invoice Terms: All invoices are due immediately upon receipt unless otherwise agreed in writing.

2.4 Usage Release Upon Payment: Usage rights to any content created by Media Productions are granted onlyonce full payment of all related invoices has been received.

 

3. CANCELLATIONS & RESCHEDULING

Deposits are non-refundable. Projects may be rescheduled once at no additional cost with at least 7 days’ notice.Rescheduling within 7 days may incur additional fees due to lost production time. Outdoor shoots affected byunsafe or unsuitable weather may be rescheduled at no additional charge, subject to availability.

 

4. PRODUCTION SCOPE & REVISIONS

Deliverables, shoot duration, and included revisions are defined in each quotation. Revision allowances vary perproject. Any edits, content, or changes requested outside the agreed scope will be billed at R1000 per hour.

 

5. TURNAROUND TIMES

Standard delivery timelines are 1–2 weeks from shoot date for typical projects and up to 3 weeks during highproduction periods. Timelines may vary depending on project complexity and workload.

 

6. CONTENT OWNERSHIP & USAGE

Upon full payment the Client receives full usage rights to final delivered content. Media Productions retains theright to use the content for portfolio, marketing, and promotional purposes unless exclusivity is agreed in writing.Raw footage is not included in standard packages and may be supplied upon request at additional cost.

 

7. FILE STORAGE & ARCHIVING

Media Productions retains project files and deliverables for approximately 30–90 days after final delivery.Long-term archiving is not guaranteed. Requests for retrieval, re-export, or re-delivery after this period may incurfees.

 

8. CLIENT RESPONSIBILITIES

The Client is responsible for providing accurate briefs where required, ensuring subjects and locations areprepared and available, and obtaining location permissions and permits. For drone shoots, signed locationpermission must be provided at least 7 days before the shoot.

 

9. CLIENT REVIEW & APPROVAL

The Client is responsible for reviewing all deliverables during the revision stage. Media Productions is not liable forerrors, omissions, or changes requested after final approval or after content has been published or distributed bythe Client.

 

10. PRODUCTION LIMITATIONS

Media Productions is not liable for missed or incomplete content where circumstances beyond our control occur,including unavailable participants, restricted access, event schedule changes, or environmental limitations.Reasonable efforts will be made to achieve agreed deliverables.

 

11. SAFETY & WORKING CONDITIONS

Media Productions reserves the right to suspend or cease production where unsafe conditions, harassment, orrisk to personnel or equipment are present. All fees for time incurred up to that point remain payable.

 

12. EQUIPMENT DAMAGE

The Client is liable for damage to Media Productions equipment caused by negligence or actions of persons underthe Client’s control during production.

 

13. TRAVEL & LOCATION COSTS

Travel within the Johannesburg metropolitan area is included unless otherwise stated. Travel outside this areamay incur additional fees quoted in advance.

 

14. LIABILITY

Media Productions’ liability for any claim related to services provided shall be limited to the total project fee paid bythe Client. Media Productions shall not be liable for indirect, consequential, or business losses arising fromdelivered content.

 

15. RETAINER SERVICES

Monthly retainer agreements may be terminated by either party with 30 days’ written notice. Unused deliverableswithin a billing period do not roll over unless agreed in writing.

 

16. FORCE MAJEURE

Media Productions shall not be liable for failure to perform due to events beyond reasonable control includingsevere weather, equipment failure, illness, government restrictions, or venue closure.

17. GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

 

ACCEPTANCE

Acceptance of any Media Productions quotation or payment of deposit constitutes acceptance of these Terms &Conditions.
